ALEXANDRIA, Va. (WUSA9) -- On Monday, a judge will hear Monday arguments concerning whether or not the suspect in the shooting of Officer Peter Laboy can challenge the forensics used by the Alexandria Police Department. Laboy was shot in the head in February during a routine traffic stop, according to authorities.
The Commonwealth had stated that Kashif Bashir cannot call a forensic scientist to challenge their testing methods. Friday, Bashir's defense filed a response to the Commonwealth's Motion to Quash, claiming Virginia law allows him to cross-examine any witnesses who testify against him.
The hearing is set for 11 a.m. Monday in Alexandria General District Court.
