Jury Deliberates In Capitol Hill Beating Trial Of Thomas Maslin

WASHINGTON (WUSA9) -- Jurors went home for the night after spending about half an hour deliberating the fate of Tommy Branch, the man accused of smashing a young Capitol Hill father in the head with baseball bat last summer and leaving him for dead.

Thomas Maslin, 29, is so severely brain injured that prosecutors say he was unable to testify about what Branch and two other men allegedly did to him.

Instead, prosecutors' final witness was Abby Maslin, who told jurors it took her husband a week to even respond to her words in the intensive care unit and squeeze her hand.

Branch's lawyer has seized on a discrepancy between the physical evidence and the testimony of a key prosecution witness. Michael Moore said he saw Branch hit Maslin in the back of the head. But his injuries were actually to the side of his head.
