According to evidence, Hayes shot and killed Moore, 37, on June 10, 2009.  Hayes reportedly was angry with Moore from an earlier dispute and waited for the victim by his parked car in a lot behind 1310 Columbia Road NW.  When Moore arrived, evidence states that Hayes shot him five times and left him to die next to his car.

There were no eyewitnesses to the shooting, but Hayes told several people about the murder.

One person he told was a 15-year-old girl who had sexually assaulted in August 2009.
