WASHINGTON, DC (CBS) -- John Allen Muhhamad, one of the snipers who murdered at least ten people seven years ago is scheduled to be executed Tuesday by lethal injection.  So far, last minute appeals have been unsuccessful and victims' families are preparing for the final step in their pursuit of justice.

One of those is Bob Meyers, brother of Dean Harold Meyers, who was killed in Manassas at a Sunoco gas station.

Bob Meyers was shocked when he learned his older brother, Dean, had been  shot and killed.

"I don't really remember what I said, but I probably said something like, 'No, it can't be or there must be a mistake.'"

Dean Harold Meyers was one of ten people killed when John Allen Muhammad, and  his teenage accomplice Lee Boyd Malvo, carried out a three week killing spree in Virginia, Maryland and Washington, DC back in 2002.

Meyers was a decorated Vietnam Veteran who survived a gunshot wound from a sniper back then only to be gunned down more than three decades later as he filled his Mazda at a gas station near his office.  He was shot in the head, and died  instantly.

Muhammad is scheduled to die by lethal injection Tuesday for killing  Meyers who worked as a civil engineer.  His brother will be there to witness  the execution.  But, he is not looking forward to it.

"We don't consider that there's any winners in this.  We're not ready to celebrate his death," says Meyers.

Meyers says while his family didn't push for the death penalty, Bob Meyers believes justice will be served when Muhammad is put to death.
